Frequently Asked Questions – Bankruptcy Law (UT, NJ & SDTX)

❓ Do I qualify for bankruptcy?

It depends on your income, debt type, assets, and recent financial activity.

  • Chapter 7 is typically for low-income individuals with mostly unsecured debt (credit cards, medical bills).

  • Chapter 13 is for individuals with regular income who need to catch up on secured debt (mortgages, cars).

  • Chapter 11 is often used by small businesses to restructure while staying operational.

We'll review your situation during your consultation and explain what options are available.

❓ Will I lose my home, car, or personal property?

Not necessarily. Many clients keep their home, vehicle, and personal items by using state or federal exemptions.
We’ll walk you through what’s protected and what may be at risk based on where you live and what you own.

❓ What debts can be discharged in bankruptcy?

Most unsecured debts can be wiped out, including:

  • Credit cards

  • Medical bills

  • Personal loans

  • Past-due utility bills

  • Old lease or cell phone contracts

However, some debts cannot be discharged, such as:

  • Most student loans

  • Recent taxes

  • Child support and alimony

  • Court fines or criminal restitution

❓ How long does bankruptcy stay on my credit report?

  • Chapter 7: up to 10 years

  • Chapter 13: up to 7 years
Despite that, many clients are able to rebuild credit within 12–24 months by using secured credit cards, budgeting, and keeping debts low.

❓ Will I have to go to court?

You will not have to appear before a judge unless there are disputes. However, you must attend a meeting of creditors (341 meeting) with the bankruptcy trustee. It’s typically short and can often be done remotely.

❓ Can I file bankruptcy and keep my business open?

Yes, in many cases. If you’re a sole proprietor, you can often file under Chapter 13 and keep operating.
If you own an LLC or corporation, you may be eligible for a Subchapter V Chapter 11 to reorganize while staying in business.

❓ What does the consultation include?

During the consult, we will:

  • Review your income, debt, and asset situation

  • Identify your eligibility for Chapter 7, 13, or 11

  • Explain the steps, timeline, and documents needed

  • Go over attorney fees and filing costs

  • Answer your questions openly and without judgment
